San Bernardino County family court hired social worker charged in deadly LA County child abuse caseFrom an article By Joe Nelson, The Sun
POSTED: 04/18/16, 2:44 PM PDT | UPDATED: ON 04/18/2016 A former Los Angeles County social worker recently charged in connection with the death of 8-year-old Gabriel Fernandez has been working on child custody cases in San Bernardino County for more than two years, a court spokesman said Monday.
Kevin Bom, 36, of Phelan has worked as a child custody recommending counselor in San Bernardino Superior Court’s Family and Children Services Division since late 2013, court spokesman Dennis Smith said Monday. Bom was formerly a supervisor with the Los Angeles County Department of Children and Family Services. He was fired following the death of the 8-year-old on May 24, 2013. Gabriel suffered a fractured skull, had BB-gun pellets shot into his groin and lung, was burned with cigarettes, and had two teeth knocked out, according to court records. Gabriel’s mother, Pearl Fernandez, and her boyfriend, Isauro Aguirre, have each been charged with capital murder with a special allegation of torture. Each have pleaded not guilty, and are facing the death penalty if convicted. On April 7, Bom, former L.A. County social workers Stefanie Rodriguez and Patricia Clement — and Gregory Merritt, another Department of Children and Family Services supervisor — were each charged with one felony count of child abuse and one felony count of falsifying public records. Prosecutors allege the four were negligent and minimized dozens of complaints filed against Gabriel’s mother, Pearl Fernandez. Court records show there were more than 60 complaints lodged with L.A. County DCFS and eight separate investigations started on the family, including one underway when Gabriel died. Smith would not provide additional details on Bom’s employment in San Bernardino County, which came after his termination of employment in Los Angeles County in 2013. “Upon notification of criminal charges, the court took immediate action,” Smith said. He did not clarify what that action was, but did say it was concerning Bom’s employment. “Since these matters concern personnel issues, we are unable to discuss them further,” Smith said. Smith also declined to discuss the number of family law cases Bom has been involved with since his employment in San Bernardino County. Victorville attorney Jim Terrell said Bom served as a mediator on a nearly 10-year-old family law case of his in which the mother accused the father of psychologically abusing his two teenage daughters. During a March 3 court hearing in Victorville, Bom, after interviewing the two parents and their daughters, recommended custody go to the mother. The case is now pending in juvenile dependency court, Terrell said. He said the court should have all the cases in which Bom made custody recommendations pulled and revisited to ensure Bom did his due diligence. “If he was falsifying records, he has no credibility at all,” Terrell said of the charges Bom is facing in L.A. County. “Although it hasn’t been proven yet, it certainly is something everybody (in San Bernardino County) should have been made aware of. It is outrageous that this guy is in this position in the first place.” |
